General conditions of sale

The purchase of products offered on the Versaty Website is subject to these general terms and conditions of sale (“General Terms and Conditions of Sale”). These terms and conditions apply to the exclusion of all other terms and conditions, including those applicable to in-store sales. Versaty may modify or update these General Terms and Conditions of Sale at any time. You can review the current version of the General Terms and Conditions of Sale at any time by clicking on the “General Terms and Conditions” links.

ORDERING TERMS (01)

The Versaty website allows you to order “Versaty” brand products online via www.Versaty.fr.

Hereinafter referred to as “the Versaty Website.”

The products are described and presented as accurately as possible, with a mention of their essential characteristics within the meaning of Article L. 111-1 of the French Consumer Code.

Whenever you place an order on the Versaty Website, you will be asked to confirm your acceptance of these General Terms and Conditions of Sale in effect on the date your order is placed by checking the box provided for this purpose. Failing this, the order cannot be placed.

You must carefully check the accuracy of your selection before confirming your order. You are informed that the order is subject to a payment obligation.

An order confirmation will be sent to you by email; this email contains, on the one hand, an acknowledgment of receipt of your order, along with a description of the selected Versaty products, the quantity, price, and shipping costs, and the associated payment, and, on the other hand, the General Terms and Conditions in the version accepted by you, thus constituting proof of the order and the contract entered into.

Unless proven otherwise, the data recorded by Versaty constitutes proof of all transactions between Versaty and its customers.

The order status can be viewed at any time by the customer from your customer account accessible from the Versaty website, which is accessed only by a password chosen by you. The information and details provided by the customer may be modified at any time by the customer; the latter can also access information relating to any previous orders. 

AVAILABILITY (02)

Our product offers and prices are valid as long as they are visible on the website, while stocks last. In the event that a product becomes unavailable after you have placed your order, we will inform you by email as soon as possible, offering you the option to order another item presented on the Versaty website as a replacement, or to cancel your order. If you choose to cancel your order, you will be immediately refunded if your bank account has been debited.

Versaty reserves the right to change the products offered for sale on the Versaty website at any time and without notice.

AVAILABILITY (03)

Versaty product prices are listed in euros, inclusive of all taxes, excluding processing and shipping costs.

Versaty reserves the right to modify the prices of products offered on the Versaty Website at any time and without notice. Products are invoiced based on the prices displayed on the Versaty Website at the time your order is placed, subject to availability of the products ordered at that time.

Products remain the property of Versaty until full payment has been received by Versaty. However, you assume the risks (including loss, theft, or damage) for the delivered products from the actual delivery date.

Except for the refunds provided for below, Versaty will not refund the VAT applied to purchases made on the Versaty Website (even if the buyer, after receipt, reships the Versaty products to a country outside the European Union).

PAYMENT (04)

Any order placed on the Versaty Website must be paid for immediately upon placing your order. We only accept payments by credit card and PayPal.

All orders are payable in euros. Your order will only be shipped after verification of your payment method and receipt of debit authorization from your card.

Your credit card will only be charged when your order is shipped. If certain items ordered are unavailable, only the price and shipping costs for the available products will be charged.

Versaty uses SSL encryption to protect all personal information and payment methods. In all secure areas where the URL begins with https:// (where the “s” stands for secure), information is encrypted and therefore protected before being transferred over the Internet.

For some orders, you may be asked to make an authenticated and secure payment using the 3D Secure system (via “Verified by Visa®” or “MasterCard® SecureCode”). In this case, you will need to enter the personal information requested by your bank to complete your payment.

The following payment methods are accepted: Carte Bleue, Visa, American Express, MasterCard and PayPal.

FRAUD PREVENTION (05)

Versaty reserves the right to cancel or refuse an order from a customer with whom it is in dispute over a previous order, or if Versaty reasonably believes that the customer has violated these Terms and Conditions or engaged in fraudulent activity, or for any other legitimate reason.

In the event of loss, theft, or any fraudulent use of your password, you agree to immediately notify Versaty.

DELIVERY (06)

Products purchased on the Versaty website can be delivered worldwide.

Shipping is free for all orders over €100.

Before final confirmation of your order, the shipping costs are clearly displayed.

Products are shipped to the delivery address you provided when placing your order.

Please note that any customs fees in certain countries are not included in our prices and are the sole responsibility of the customer.

Orders are delivered via DPD in accordance with the indicative shipping times below, plus a maximum 72-hour processing and delivery time for your order to the carrier.

Metropolitan France: approximately 2 to 3 business days
European countries: approximately 4 days (minimum indicative delivery time in business days).
In the event of a delay of more than 7 days, you have the option to cancel your order and allow us additional time to deliver, in accordance with legal provisions. In this case, if you have received the product after your cancellation, we will refund the product and cover the return shipping costs within 14 days of receiving it, complete and in its original condition.

Versaty reserves the right to split deliveries. Your credit or payment card will be charged in the same way to reflect the price of the products actually delivered. Shipping costs will only be charged for a single shipment and in accordance with the information provided in your order summary.

DELIVERY PROBLEMS (07)

Any delivery defect or delay exceeding seven (7) days must be reported to our Customer Service Department as soon as possible.

You must check the conformity of the goods upon delivery and indicate, if possible on the delivery slip, any anomalies noted (open package, damaged product, etc.) in the form of handwritten reservations accompanied by your signature. You must then contact Customer Service within three (3) days of delivery (or ten (10) days of delivery if the carrier cannot provide proof of having given the consumer the opportunity to verify the good condition of the products) by email at commercial@versaty.fr.

CANCELLATION – RETURNS – EXCHANGES – REFUNDS (08)

Once completed, your order is sent to Versaty for processing.
You can modify or cancel it by contacting customer service by email at commercial@versaty.fr.
RIGHT OF WITHDRAWAL (RETURNS – EXCHANGES – REFUNDS)
In accordance with current legal provisions, you have 14 days from receipt of your products to exercise your right of withdrawal without having to provide a reason or pay a penalty. In the case of split deliveries, the withdrawal period starts from the last delivery. A standard withdrawal form is attached below. The Customer may use the withdrawal form below or exercise their right on any other medium as long as said right is exercised in an unequivocal or ambiguous manner.

If you exercise your right of withdrawal within the above-mentioned period, the price of the product(s) purchased and the shipping costs will be fully refunded; you will be responsible for return shipping costs. Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.) so that they can be resold as new, and accompanied by a copy of the purchase invoice for optimized management.

In accordance with current regulations, the right of withdrawal cannot be exercised for products unsealed by the customer or products that have been personalized at your request.

You may return any product ordered on the Versaty website for an exchange or refund, in accordance with the conditions set forth for delays of more than 7 days from the estimated delivery date or the right of withdrawal. Refunds for returned products will be issued within fourteen (14) calendar days of the date we received the products returned by you.

To request a return, please send the completed withdrawal form above to commercial@Versaty.fr. Our Customer Service team will then contact you and advise you on the next steps.

In accordance with legal provisions, the right of withdrawal does not apply to opened and/or used consumable products, to products whose protective covers or seals have been opened, or to products or product packaging damaged to the extent that they cannot be resold.

Indeed, for legal reasons related to transport, the return of these products containing alcohol is subject to a specific procedure. The following conditions apply to perfume returns:

The product must be unopened and returned in its original packaging (in transparent film).
In the event of a return due to a defective or damaged product, the customer must ensure that the bottle is still airtight (if not, please contact our Customer Service).

In the event of an exchange (except for a product received as a gift): If the value of the product(s) chosen as a replacement is greater than the value of the returned product(s), you will be required to pay the price difference in accordance with these General Terms and Conditions of Sale.

If the value of the product(s) chosen as a replacement is less than the value of the returned product(s), the price difference will be refunded to you by Versaty in accordance with these General Terms and Conditions of Sale, except in the case of a gift order.

In the event of an exchange, the shipping costs for the first delivery will be refunded, but the shipping costs for the second shipment will be charged. The products must be returned under the conditions indicated in the previous paragraph. Versaty will refund the product within fourteen (14) business days of receiving the returned products, by crediting your credit card. We do not offer a refund, even partial, if you received the product as a gift.

LEGAL GUARANTEES – WARRANTY EXCLUSIONS (09)

In accordance with applicable legal provisions, we will refund or exchange defective, non-compliant, or non-matching products.

Products sold on the Versaty Website are subject to the legal warranty conditions set out in Articles L 211-4, L 211-5, and L 211-12 of the French Consumer Code, as well as Articles 1641 and 1648 of the French Civil Code:

Article 1641 of the French Civil Code: The seller is bound by the warranty for hidden defects in the item sold that render it unfit for its intended use, or that so diminish this use that the buyer would not have purchased it, or would have paid a lower price for it, had they been aware of them.

Article 1648 of the French Civil Code: Actions resulting from latent defects must be brought by the purchaser. within two years of discovering the defect. In the case provided for in Article 1642-1, the action must be brought, under penalty of foreclosure, within one year following the date on which the seller can be released from apparent defects.

Article L211-4 of the French Consumer Code: The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when this was the seller’s responsibility under the contract or was carried out under his responsibility.

Article L211-5 of the French Consumer Code: To comply with the contract, the good must: Be fit for the use normally expected of a similar good and, where applicable, correspond to: the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model; present the qualities that a buyer can legitimately expect in light of public statements made by the seller, the producer, or their representative, particularly in advertising or labeling; or present the characteristics defined by mutual agreement by the parties or be fit for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.

Article L211-12 of the French Consumer Code: Action resulting from a lack of conformity is time-barred after two years from delivery of the good.

INTELLECTUAL PROPERTY (10)

The Versaty website is protected by copyright. The use of all or part of the website, including downloading, reproduction, transmission, or representation on any media and by any means, for purposes other than personal and private use for non-commercial purposes, is strictly prohibited.

The company names, trademarks, and distinctive signs reproduced on the Versaty website are also protected by trademark law. The reproduction or representation of all or part of any of the aforementioned signs requires prior written authorization from Versaty.

Generally speaking, any unauthorized reproduction or representation of trademarks, logos, designs, models, literary, musical, audiovisual, photographic works, and more generally any element likely to be protected by an intellectual property right accessible on the Versaty Website is prohibited and would constitute an infringement within the meaning of Articles L335-2 et seq. of the Intellectual Property Code, unless such reproduction or representation is reserved exclusively for strictly personal and private use.

 

LIMITATION OF LIABILITY (11)

Under no circumstances shall Versaty be held liable for any indirect, incidental, special, or consequential damages, including, but not limited to, loss of business, loss of profit, or loss of opportunity, resulting from the purchase of Versaty products on the Versaty Website.

Versaty shall not be liable for its obligations under these Terms and Conditions if the failure to perform its obligations is attributable to the actions of a third party, even if foreseeable, to the fault of the customer, or to the occurrence of a force majeure event as defined by French courts, or to any other event beyond Versaty’s reasonable control.

The products offered comply with current French and European legislation and the standards applicable in France and Europe. Versaty cannot be held liable for non-compliance with the laws of the country where the product is delivered (for example, in the event of a product ban).

It is your responsibility to check with local authorities regarding the import or use of the products you plan to order.

The photographs are provided for illustrative purposes. Versaty cannot be held responsible for any errors or inaccuracies in the photographs or graphic representations of Versaty products appearing on the Versaty Website.

Their use is at the user’s own risk and sole responsibility. In particular, the use of hypertext links may lead Internet users to consult the Site and access other servers to find the information they are looking for, servers over which Versaty has no control and does not intend to assume any risk relating to their content.

Versaty makes every effort to ensure the reliability of the information contained on its Site. However, Versaty does not guarantee that: The Site, the content, and the products offered will fully meet users’ expectations, that the Site will be uninterrupted and error-free, that these interruptions or errors will be corrected, or that the Site will be virus-free.

The information and data concerning you are collected by the company VERSATY. This data is necessary for the management of your order and our commercial relations. It may be transmitted to companies that contribute to these relations, such as those responsible for the execution of services and orders for their management, execution, processing, and payment.

This information and data are also retained for security purposes, to comply with legal and regulatory obligations, and to enable us to improve and personalize the services we offer and the information we send you.

In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify, and object to any personal data concerning you. Simply write to us online at commercial@versaty.fr or by mail to Versailles Beauté, 39 Avenue Gaston Imbert, 13790 Rousset, providing your first and last name, email address, and address.

In accordance with current regulations, your request must be signed and accompanied by a photocopy of an identity document bearing your signature. You must also specify the address to which the response should be sent. A response will then be sent to you within two months of receipt of the request. Depending on the choices you made when creating or accessing your account, you may receive offers and information from our company. If you no longer wish to receive this information, you can request it at any time by specifying this in your account.

If the customer’s telephone number is collected when creating their account or placing their order, we inform the customer that their telephone contact information will only be used to properly fulfill their orders or to contact them to offer them new services.

These General Terms and Conditions of Sale are governed by and interpreted in accordance with French law. These General Terms and Conditions of Sale are written in French. Any potential disputes will be subject to the exclusive jurisdiction of the French courts. The customer is informed of the possibility, in the event of a dispute, of resorting to a conventional mediation procedure or any other alternative dispute resolution method.
